11-year-old accused of shooting a neighbor kept in custody

A judge on Tuesday decided to keep an 11-year-old boy accused of killing Jenesis Dockery in juvenile custody.

Jenesis was shot in July by her babysitter's 11-year-old son, her family says, and so far the boy is the only one facing charges. Her parents have asked how the boy got access to a gun and why an adult is not charged.

The attorney representing the 11-year-old and his family asked that he be released to his grandparents, saying he is not a threat.

Fon Dockery, father of Jenesis, says the decision to keep the boy in custody will allow prosecuting attorneys time to present additional evidence they hope would keep him detained.

The parents of the 11-year-old did not respond on Tuesday to WRAL's request for comment.
