Joint murder trial set for May in killing of retired deputy chief's son

DURHAM, N.C. — The man and woman charged in connection with the murder of a former Durham deputy chief's son are expected to go to trial later this year.

A joint trial for Toney Allen Smith Jr. and Nitisha Page is set for May 20.

Smith is charged with the first- degree murder of Anthony “A.J.” Marsh Jr. in April 2021, and Page is charged with accessory after the fact.

Marsh was the son of retired Deputy Police Chief Anthony Marsh Sr.

Prosecuting lawyers said they are still waiting for evidence from law enforcement that will have to go to the defense as well.
