The California Supreme Court has agreed to hear all three cases challenging Proposition 8. From my reading of the situation, it doesn't even appear that they've consolidated the cases (although that may be something that happens later on - I'm not sure.) If not, each case would be heard individually, giving three shots to get rid of this thing.
Even if they do consolidate the cases into one, their viewpoint on the matter (and a good indicator of how they'll rule on these cases) seems to have already been given in their original ruling on In re Marriage Cases, the court case that started the whole business in the first place.
They said (and this is a direct, word for word quote from the ruling itself) that said the right to marry is among a set of basic human rights "so integral to an individual's liberty and personal autonomy that they may not be eliminated or abrogated by the legislature or by the electorate through the statutory initiative process."
This will be interesting to watch unfold. :-D

Then companies would need to consider couples "living in sin" (to borrow the term I've heard all my life) for benefits as well as gay/lesbian couples. That would be quite an expensive problem.
