Attorneys for the two men charged in the murder of Wake County Deputy Ned Byrd appeared in court Thursday.

RALEIGH, N.C. — Attorneys for the two men charged in the murder of Wake County Deputy Ned Byrd appeared in court Thursday.

Neither Arturo Marin-Sotelo nor Alder Marin-Sotelo were present for the hearing, and a trial date has not been set.

Attorneys representing Alder Marin-Sotelo said he has not returned from Mexico where he was captured, and they have not spoken to him since last April. Arturo Marin-Sotelo remains in the Wake County jail.

Byrd was shot and killed late in the evening on Aug. 11, 2022. He was on his way to K-9 training when he pulled over to investigate a suspicious truck on the side of Battle Bridge Road in southeastern Wake County.

Byrd pulled up to the truck, leaving his K-9, Sasha, in the car. He was shot four times, including three shots to the back of the head, and died on the road.
